Terms and Conditions for mentzart.com Online Store

I. General Provisions

These terms and conditions govern the operation of the mentzart.com online store (hereinafter “Store”).
The Store is operated in Poland, EU by company:

The Store offers digital photographs for download, which are the property of the author, Pavel Mentz (hereinafter “Author”).

II. Purchase and Download of Photographs

Purchase of Photographs

(a) To purchase a photograph, the Customer must make a payment through the provided payment gateways.

(b) Upon successful payment, the Customer will receive access to a download link for the purchased photograph.

Download of Photographs

(a) The Customer has the right to download the purchased photograph from the mentzart.com website using the provided download link.

(b) Downloaded photographs are intended for personal or commercial use by the Customer, subject to the license terms specified by the Author (see Section V – Photograph License).

III. Prices and Payments

Photograph Prices

(a) Prices of photos in the Store are quoted in US dollars and do not include VAT.

(b) The Store reserves the right to change prices at any time. Changes in prices will not affect the prices of already purchased photographs.

Payments

(a) The Store accepts payments through third-party payment gateways, such as credit card payments and Paypal.

(b) The Store does not store Customers’ credit card details.

IV. Complaints and Returns

Complaints

(a) In case a purchased photograph is damaged or does not meet the Customer’s expectations, the Customer has the right to file a complaint.

(b) Complaints should be submitted via email to info@mentzart.com within 14 days from the date of purchase.

Returns

(a) The Store does not accept returns of purchased photographs unless they are defective or not as described.

(b) Returns will be handled according to the complaint policy described in Section IV – Complaints.

V. Photograph License

All photographs available in the Store are subject to a Creative Commons or other licenses granted by the Author.
The Photograph License specifies the rights and limitations regarding the use of purchased photographs.
The Customer is required to comply with the license terms and may not infringe the Author’s copyrights or use photographs in a manner inconsistent with the license terms.

VI. Personal Data Protection

The Store processes Customers’ personal data in accordance with the privacy policy available on the [Enter Privacy Policy Link] page.
The Store guarantees the confidentiality and protection of Customers’ personal data in accordance with applicable law.

VII. Invoices and Tax Responsibility

Invoices

(a) The Seller will issue invoices for purchased photographs. The invoice will be sent to the Customer via email to the email address provided during the purchase process.

(b) The invoice will include all necessary details required for accounting and tax purposes.

VAT and Tax Responsibility

(a) The Seller is not a VAT-registered entity and does not charge VAT on the sales of photographs.

(b) The Customer acknowledges that the Seller is not a VAT-registered entity and agrees that the Seller will not charge or collect any VAT on the purchased photographs.

(c) The responsibility for any applicable taxes, including VAT, lies with the Customer in accordance with the laws and regulations of their country of residence or business operation.

(d) The Customer is responsible for complying with their local tax regulations and reporting the purchase of photographs in accordance with their tax obligations.

VIII. Final Provisions

The Store is operated in compliance with the laws and regulations of Poland. The information provided in the Terms and Conditions aims to ensure transparency and a smooth purchasing process for Customers.
By using the Store and purchasing photographs, the Customer agrees to abide by these Terms and Conditions.
The Seller reserves the right to amend these Terms and Conditions at any time. The updated Terms and Conditions will be effective upon their publication on the Store’s website.
In case of any discrepancies between different language versions of these Terms and Conditions, the Polish version shall prevail.
Any matters not regulated in these Terms and Conditions shall be governed by the applicable laws of Poland.
Any disputes arising from the sales agreement will be settled by the competent common courts.
